General Requirements

The WCRA database is private, and access is limited to (a) current employees of a member insurance company or self-insured organization (Members) and (b) current employees of third-party administrators (TPAs) designated by a WCRA member as an agent for that Member.

Security

For security reasons, the WCRA staff does not provide login information over the phone. If the password has been misplaced, please use the “Forgot Password?” option on the login menu. For any other issue, please contact the WCRA.

Members and TPAs are responsible for maintaining the confidentiality of the passwords assigned to their employees and are fully responsible for all activities that occur under these usernames and passwords. Members and TPAs agree to (a) immediately notify WCRA of any unauthorized use of the usernames and passwords or any other breach of security, and (b) ensure that all Member and TPA employees exit from the website at the end of each session. WCRA is not liable for any loss or damage arising from Member’s or TPA’s failure to comply with these provisions. Members and TPAs agree to indemnify the WCRA for any damage caused by the misuse of usernames and passwords assigned to Member and TPA employees.

MEMBERS AND TPAS MUST NOTIFY THE WCRA IMMEDIATELY IF A MEMBER OR TPA EMPLOYEE SHOULD NO LONGER BE AUTHORIZED TO ACCESS THE WCRA SECURE WEBSITE.  MEMBERS AND TPA AGREE TO TAKE AT LEAST THE SAME PRECAUTIONS TO ENSURE THAT ANY INFORMATION OR DATA SENT TO THE SITE ARE FREE FROM VIRUSES, WORMS, TROJAN HORSES OR OTHER MALICIOUS CODES AS THEY TAKE TO PROTECT THEIR OWN COMPUTER SYSTEMS.

The WCRA makes no representations or warranties that the information accessible via this site is accurate, complete, or current. This site could contain typographical errors or technical inaccuracies. The WCRA reserves the right to add to, change, or delete its content or any part thereof without notice. The WCRA does not promise that the website will be error-free or access to it will be uninterrupted. The website and all content within it is delivered on an “as is” and “as available” basis. Under no circumstances will the WCRA be liable in any way for any information or content, including, but not limited to, any errors or omissions in any information or content, or for any loss or damage of any kind incurred as a result of the use of any information or content, posted or otherwise transmitted via this site.

THE WCRA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT.

Limitation Of Liability

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, TORT, OR NEGLIGENCE, WILL THE WCRA OR ITS OFFICERS, DIRECTORS, EMPLOYEES, SUPPLIERS OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, TRANSMITTING, OR DISTRIBUTING THIS SITE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) THAT ARISE OUT OF OR ARE RELATED TO THE ABILITY OR INABILITY TO USE THIS SITE, ANY CONTENT PROVIDED BY OR THROUGH THIS SITE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF MEMBER OR TPA TRANSMISSIONS OR DATA, OR OTHER INFORMATION THAT IS SENT OR RECEIVED. IN NO EVENT SHALL THE WCRA’S AGGREGATE LIABILITY TO ANY MEMBER OR TPA FOR ANY LOSS, DAMAGE, OR CLAIM RELATED TO OR ARISING OUT OF THE SITE, ITS CONTENT, OR RELATED SERVICES EXCEED THE TOTAL AMOUNTS, IF ANY, PAID BY A MEMBER OR TPA TO THE WCRA FOR ACCESSING THIS SITE.

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT, OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF THE DATA DISPLAYED ON THIS SITE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.

Termination

The WCRA reserves the right to terminate the site at any time without notice if the security of the site has been compromised in any way; or to terminate access to the site by any Member or TPA without notice if there is unauthorized use of the Member’s or TPA’s access to the site; or to terminate the site for any other reason upon ten days written notice to the subscribing Members or TPAs.

Choice of Law

This agreement shall be governed by and interpreted in accordance with the laws of the United States and the State of Minnesota.
