Claims
The determination of coverage and compensability for a COVID-19 claim under the Minnesota workers’ compensation system is the responsibility of our insurer and self-insurer members. The WCRA will classify all COVID-19 workers’ compensation claims as an occupational disease, as defined in MN Statute §176.011, subd. 15. A separate WCRA retention applies per person for occupational disease claims, per MN Statute §79.34, subd. 2. The WCRA does not require reporting of COVID-19 claims until the total incurred loss reaches 50 percent of the retention.
